Rules and Regulations

The Rules and Regulations of your Association are designed and established to allow every property owner maximum use and enjoyment of Hickory Run Forest. The Rules and Regulations work in conjunction with Association By-Laws, and the protective Covenants filed in the Carbon County Courthouse.

All owners have an obligation to every other owner to see that these Rules and Regulations are observed in order to maintain what we have and to ensure that Hickory Run Forest continues to grow and prosper.

  1. Use of Facilities
    The use of Association facilities is restricted to members in good standing, members of their family living with them, and their guests. Every member shall be responsible for the acts and conduct of their families and guests.
  2. Clubhouse - No smoking permitted in the Clubhouse.
  3. Lake - Boating
    • Access to our lake is prohibited after sunset.
    • No swimming is permitted unless a lifeguard is on duty.
    • All boats must be registered to a Hickory Run resident for use on our lake.
    • All boats must be equipped with U.S. Coast Guard-approved floatation devices.
    • All boaters must abide by State and Federal rules governing boating.
    • Only electric motors are permitted on the lake.

  5. Roads
    The speed limit on all roads in Hickory Run Forest is twenty (20) miles per hour. All Pennsylvania laws and restrictions governing the use and operation of motor vehicles on roads and highways shall apply on all roads in the Hickory Run Forest Development.
    Parking is not permitted on any of the roads in Hickory Run Forest.
    HRF stickers identifying the vehicles of members and their families must be displayed on the front mirror of their vehicle.
  6. Maintenance of Private Property
    In the event an owner does not maintain his property in a safe manner, keeping it free of any nuisance, refuse, or garbage, the Board may correct the unsafe condition, after written notification to the owner(s) to correct the problem. The Association will bill the owner(s) for all costs incurred in correcting the unsafe condition.
  7. Household Pets
    Common domestic household pets are permitted within Hickory Run Forest. They should be licensed in accordance with state law.
    Pets must be kept on the owner's property and not allowed to run loose. The owner of a pet is required to clean up after his pet.
  8. New Construction or Alterations
    See below concerning Rules and Regulations for New Construction or Alterations.
  9. Hunting
    No hunting or discharging of firearms is permitted within Hickory Run Forest.
  10. Recreation Vehicles
    Recreational vehicles are defined as: motorbikes, motorcycles, all-terrain vehicles, snowmobiles, or any other motorized recreational vehicle using the roads or property of Hickory Run Forest.
    All recreational vehicles used on our property must be registered to a Hickory Run property owner. Recreational vehicles must display an official HRF registration sticker. Recreational vehicles must be licensed and insured in accordance with Pennsylvania law.
    Safety helmets must be worn by everyone riding a recreational vehicle. The speed limit on all roads is twenty (20) miles per hour. The hours of operation for recreational vehicles will be from 9:00 a.m. to dusk.
  11. Leasing/Rental of Homes
    A member must notify the Association of their intent to rent their home. They must provide the Association with the name(s), address(es), and telephone number(s) of all renters.
    Any owner(s) who lease/rent their property accept all responsibility and liability for the conduct of the lessee/renter.

  15. Enforcement

In accordance with the By-Laws, the Board of Directors of Hickory Run Forest has the power to enforce the Rules and Regulations. Violations should be reported to an Association officer. An official notice of any alleged violation of the Rules and Regulations should be presented in writing or verbally to the person involved (or the property owner(s) if a minor or renter committed the violation) as soon as possible after the violation. The officer shall inform the Board of Directors of the alleged violation.

The Board shall discuss the alleged violation at its next scheduled meeting. If the Board determines that the violation is minor and/or a first offense, it shall send a letter of reprimand to the property owner(s). If the Board determines the violation to be serious and/or a second offense, it will schedule a hearing with the offending owner(s). Offending owners should appear at the hearing to defend themselves. Owner(s) have the right to be represented by counsel. After the hearing, the Board shall render a decision and determine the appropriate punishment if applicable.

The Board shall have the power to levy fines, suspend privileges of membership, and/or secure judgments against the real property of the owner(s) to collect unpaid fines.

Rules & Regulations for New Construction or Alterations

No new construction or major exterior alteration to an existing building is permitted without first obtaining written permission and approval from the Hickory Run Land & Homeowners Assn (HRLHA) Building & Zoning Committee, hereafter referred to as the Committee.

One set of building plans and specifications must be submitted to the committee for their review and approval. An approved set of permits, including a Building Permit, and a Sewage Disposal System Permit, must be obtained from Penn Forest Township and presented to the committee along with the proposed plans.

The plans submitted must include, but are not limited to, the elevations, cross-section of structure, siding material, and the location of the building or alteration on the plot plan. In addition, the well, septic tank(s), drain field construction and location, as well as the driveway must be shown on the plot plan..

HRLHA requires the payment of a construction fee, which must be submitted with the plans. A certificate of insurance shall be provided to the Committee. All Contractors shall provide a certificate with a minimum of $100,000 coverage in each area of Liability, Auto, and Workman's Compensation insurance. The insurance must remain in effect during construction.

All plans must conform to the Rules & Regulations of the State of Pennsylvania, Carbon County, Penn Forest Township, as well as the Protective Covenants, Bylaws and the Rules & Regulations of the Hickory Run Land & Homeowners Association.

Written permission must be obtained from the committee before any contractor will be permitted on the private roads of our community. This includes any individual or contractor surveying, mapping, performing perc tests, or placing markers on lots.

Once major construction (foundation, framing etc.) has begun, contractor shall maintain a dumpster on site. He shall also provide a "sanitation station" (portapotty) on site. The unit must be locked when contractor is not working on the site.

There shall be no burning of any type at the construction site. All debris shall be disposed of in a dumpster. Stumps, vegetation and building debris shall be hauled off site and not burned or buried on the site.
